Uninsured Motorist Claims

Under law, your insurance company is responsible for most of the medical bills you incur as a result of an automobile accident. It has a very specific liability spelled out in your policy. The law and the policy notwithstanding, however, many insurance companies make it their standard operating procedure to not pay uninsured motorist claims, counting on the fact that you may be reluctant to file a suit against your own insurance company. And, even if they intend to pay the bills, they will wait as long as possible before doing so.
But above and beyond your insurance company, you may be able to receive compensation from the uninsured motorist. The law in Oklahoma and Arkansas requires that all drivers have liability insurance as a prerequisite to being allowed on the road. Therefore, driving without insurance is a criminal act, one that endangers everyone on the road, and anyone who does so should be subject to the severest reprimand of the law.
Since both Oklahoma and Arkansas have tort-based automobile accident laws, the procedure for obtaining payment from an individual is not so different from obtaining it from an insurance company, but with the additional factor that you may in some circumstances be able to recover punitive damages as a result of the other motorist's deliberate misconduct in not carrying insurance. Follow the same procedures as in any automobile accident, getting as much information as possible from the other motorist(s) and any witnesses. Be sure to cooperate with police, and document everything you can about the scene of the accident, taking pictures of everything you can. Move your vehicle only if necessary to protect yourself or other motorists.
